Will Smith had loaded gun in his car when he was shot, police say

Will Smith, the former New Orleans Saints defensive end, had a loaded handgun in his car when he was shot and killed on Saturday night, New Orleans Police announced on Tuesday.
NOLA.com and other outlets had details of the police announcement. According to NOLA.com, Smith's gun was a fully loaded 9-millimeter handgun. Investigators found no evidence that Smith's gun was fired, police said.
Another weapon was found in the car of Cardell Hayes, who was arrested and charged with second-degree murder after the incident. A fully loaded revolver was found in Hayes' Hummer H2, police said, but evidence indicated it was not fired. Shell casings from another gun, a .45-caliber handgun, were found at the scene.
NOLA.com said a search warrant was needed before police could look in Smith's car and Hayes' car, and that was executed Tuesday morning.
Smith was shot and killed after going out to dinner with his wife and friends on Saturday night. Smith's wife Racquel was shot in the leg as well. Video surveillance showed a car matching the description of the Mercedes SUV that Smith drove that night apparently rear-ending the Hummer that matches the description of the car Hayes was driving. The Mercedes SUV drove off when the Hummer pulled over. There was another accident two blocks away, when Hayes' car allegedly hit Smith's car. Moments later Smith was shot and killed.
Hayes' lawyer John Fuller said that his client was not the aggressor in the incident.
