San Francisco 49ers linebacker Aldon Smith was apologetic in court on Friday as he learned his sentence for his gun and DUI convictions: 12 days in jail that can be spread out over the course of the next few months.
Although Smith didn't avoid jail time, the biggest development of the day was that he had his three weapons charges reduced from felonies to misdemeanors.
Of the 12 days, Smith was credited for one for time served, according to the San Jose Mercury News. The other 11 will be spent, one day per week starting on July 28, on a work-detail crew (such as picking up roadside garbage). The jail time will finish — coincidentally, of course — the week prior to the 49ers' Monday night game in Week 6 against the St. Louis Rams.
Smith also was fined $2,000 for the gun conviction and must serve an additional 235 hours of community service. This appears to be a fairly standard sentence despite Smith pleading no contest to three counts of felony weapon possession in May.
Now we wait for the NFL. The league can suspend him (multiple games even) for a violation of the personal conduct code, and Smith also will be out of action already one day a week to serve his sentence, so the football team and Smith will be affected by this. But it appears that the judge did not come down hard on Smith, who reportedly apologized to the judge for his actions prior to the sentencing.
